ومن لا قدرة له على مهور الحرائر المؤمنات، فله أن ينكح غيرهن، من فتياتكم المؤمنات المملوكات. والله تعالى هو العليم بحقيقة إيمانكم، بعضكم من بعض، فتزوجوهن بموافقة أهلهن، وأعطوهن مهورهن على ما تراضيتم به عن طيب نفس منكم، متعففات عن الحرام، غير مجاهرات بالزنى، ولا مسرات به باتخاذ أخلاء، فإذا تزوجن وأتين بفاحشة الزنى فعليهن من الحدِّ نصف ما على الحرائر. ذلك الذي أبيح مِن نكاح الإماء بالصفة المتقدمة إنما أبيح لمن خاف على نفسه الوقوع في الزنى، وشق عليه الصبر عن الجماع، والصبر عن نكاح الإماء مع العفة أولى وأفضل. والله تعالى غفور لكم، رحيم بكم إذ أذن لكم في نكاحهن عند العجز عن نكاح الحرائر.

Tafsir al-Muyassarfree-distribution

Sizden, hür mümin kadınlarla evlenmeye güç yetiremiyen kimse, ellerinizdeki mümin cariyelerinizden alsın. Allah sizin imanınızı çok iyi bilir. Birbirinizdensiniz, aynı soydansınız. Onlarla, zinadan kaçınmaları, iffetli olmaları ve gizli dost tutmamış olmaları halinde, velilerinin izniyle evlenin ve örfe uygun bir şekilde mehirlerini verin. Evlendiklerinde zina edecek olurlarsa, onlara, hür kadınlara edilen azabın yarısı edilir. Cariye ile evlenmedeki bu izin içinizden, günaha girme korkusu olanlaradır. Sabretmeniz sizin için daha hayırlıdır. Allah bağışlar ve merhamet eder.

Sizden her kim hür mümin kadınları nikah edecek bir zenginliğe gücü yetmiyorsa, ona da ellerinizin altındaki mümin cariyelerinizden efendilerinin rızası ile nikahlamak var. Allah sizin imanınızı daha iyi bilir. Siz birbirinizdensiniz. O halde sahiplerinin izni ile ve mehirlerini örfe göre vermek suretiyle cariyelerden iffetli olan, zina etmeyen, dost da edinmeyenlerle evlenin. Evlendikten sonra bir fuhuş yaparlarsa, o vakit hür kadınlar hakkında gerekli bulunan cezanın yarısı kendilerine lazım gelir. Bu hükümler, içinizden günah işlemekten korkanlaradır. Sabretmeniz ise, sizin için daha hayırlıdır. Allah Gafûrdur, Rahimdir (çok bağışlayıcıdır, çok merhamet edicidir).

Onları sahiplerinin izni ile nikâhlayın ve namuslu yaşamaları, zina etmemeleri ve gizli dost da tutmamaları şartı ile uygun bir şekilde mehirlerini de (bizzat) kendilerine verin! Evlendikten sonra bir çirkinlik (fuhuş) yaparlarsa, onlara hür kadınların cezasının yarısı (uygulanır). Bu (cariye ile evlenme emri), içinizden günaha düşmekten korkanlar içindir. Sabretmeniz ise sizin için hayırlı olandır. Allah çok bağışlayandır, çok merhametlidir.

If any of you have not the means wherewith to wed free believing women, they may wed believing girls from among those whom your right hands possess: And Allah hath full knowledge about your faith. Ye are one from another: Wed them with the leave of their owners, and give them their dowers, according to what is reasonable: They should be chaste, not lustful, nor taking paramours: when they are taken in wedlock, if they fall into shame, their punishment is half that for free women. This (permission) is for those among you who fear sin; but it is better for you that ye practise self-restraint. And Allah is Oft-forgiving, Most Merciful.

If any of you does not have the means to marry a believing free woman, then marry a believing slave- God knows best [the depth of] your faith: you are [all] part of the same family- so marry them with their people’s consent and their proper bride-gifts. [Make them] married women, not adulteresses or lovers. If they commit adultery when they are married, their punishment will be half that of free women. This is for those of you who fear that you will sin; it is better for you to practise selfrestraint. God is most forgiving and merciful,

Ye (proceed) one from another; so wed them by permission of their folk, and give unto them their portions in kindness, they being honest, not debauched nor of loose conduct. And if when they are honourably married they commit lewdness they shall incur the half of the punishment (prescribed) for free women (in that case). This is for him among you who feareth to commit sin. But to have patience would be better for you. Allah is Forgiving, Merciful.

And whoever among you cannot [find] the means to marry free, believing women, then [he may marry] from those whom your right hands possess of believing slave girls. And Allāh is most knowing about your faith. You [believers] are of one another. So marry them with the permission of their people and give them their due compensation [i.e., mahr] according to what is acceptable. [They should be] chaste, neither [of] those who commit unlawful intercourse randomly nor those who take [secret] lovers. But once they are sheltered in marriage, if they should commit adultery, then for them is half the punishment for free [unmarried] women. This [allowance] is for him among you who fears affliction [i.e., sin], but to be patient is better for you. And Allāh is Forgiving and Merciful.
